According to Hankyung.com, the medley of TVXQ's hit songs and the cover of "Candy" by the rookies from former SM executive Lee Sooman were parts of the JX Concert that had not been agreed upon with SM. However, industry insiders agree that there is no legal issue even without prior consent.
One source stated, "In the case of performances or YouTube content, singing or presenting choreography without the original creator's approval is classified as a 'cover stage' or 'cover video' and does not pose a problem," adding, "However, from an ethical perspective, there may be issues."
Another source also raised concerns, saying, "They left TVXQ because they were unhappy, and the original members are still actively performing—how should we resolve the situation where 75% of the concert setlist consists of TVXQ songs?" They further pointed out, "Members who have kept the TVXQ name alive for over 20 years were even mocked as 'fake,' while the members who left were referred to as the 'real' ones."
Of course, you can sing any song at a performance if you pay for it.
