Special aggravated quasi-r*pe is a crime stipulated in Article 4, Paragraphs 3 and 1 of the Special Act on the Punishment of S**ual Crimes, etc., in which quasi-r*pe is committed with a weapon or dangerous object, or two or more people join together to commit quasi-r*pe. It is a crime that is established in this case.

In other words, 1. if a dangerous weapon or other hazardous object is possessed, or if two or more people act together, 2. taking advantage of the victim's mental or physical incapacitation or inability to resist, 3. and s**ual intercourse occurs, then the crime of special aggravated r*pe is established.


Carrying a dangerous weapon or acting in concert with two or more people means that the crime of special aggravated r*pe is established. 

The term refers to objects that can be used for intimidation, and other dangerous objects refer to items that can pose a risk to a person's physical safety due to their nature. It is not necessary to actually use evidence or dangerous objects; simply having them is sufficient.

The term 'acting in concert' refers to cases where two or more individuals have a temporal and spatial relationship and commit the crime together. For example, if one person commits the r*pe while another is on lookout, or if one person r*pes the victim and then another person r*pes them afterward, or if one person threatens the victim while another person r*pes them, these situations would be classified as special aggravated r*pe."


Taking advantage of the victim's mental or physical incapacitation means that the victim must be in a state where they cannot resist due to mental or physical impairment. Here, mental incapacitation refers to a condition where the victim lacks the ability to discern or make normal judgments, while 'incapacitation' means being in a state of helplessness due to external factors.

Examples include: 1. Being inebriated to the point of being unable to make normal decisions, 2. Being unable to respond due to drug effects, and 3. Being asleep.

If s**ual intercourse occurs without using the victim's incapacitated state, such as through as**ult or threats, then it would not be classified as special aggravated r*pe, but rather as general r*pe.



For the crime of special aggravated rape to be established, there must be s**ual intercourse with the other party. Specifically, s**ual intercourse refers to the insertion of a male's s** organ into a female's s** organ. Once the insertion occurs, the duration of the intercourse or whether e**culation takes place is not questioned
